The Ministry of Human Resources and Social Development recently revealed a draft ministerial decision regarding the penalties that will be imposed on the employer in case of violating the Labor Law and its Executive Regulations, including those related to the delay in the wages of workers.

The ministry confirmed that failure to pay workers’ wages and dues on their due dates specified in their approved bank accounts, or withholding the worker’s wages, or part of it, without a judicial document is a violation of the labor system.

It indicated that the penalty stipulated in this case will be a fine of 3,000 riyals for the employer if the number of workers in the facility is less than 10, but if the number of workers exceeds 10, the employer will be punished with a fine of 5,000 riyals.

They noted that these penalties are multiplied by the number of workers who did not receive their salaries on the specified dates, or were detained without legal basis.

It is noteworthy that the ministry also confirmed that not granting the worker a day off per week, or increasing working hours more than what is stipulated in Article (98) without commissioning overtime work, or not complying with the daily rest periods granted to the worker is a violation, and the employer is fined a fine of 10,000 Real, multiple workers.
