The Ministry of Human Resources and Social Development clarified the controls for reducing the employee’s salary in the facility, and what are the cases in which the establishment is not permitted to reduce the salary and whether the worker has the right to object to the reduction of his salary or not.
In its answers to the most prominent inquiries regarding the provisions of Article No. (41), the Ministry indicated that it is not possible to reduce the worker’s wages without reducing the working hours, and that the reduction of working hours must be commensurate with the reduction of the wages, whatever the means of carrying out the work.
She added that the worker does not have the right to refuse to reduce his wages in application of the Islamic Sharia principle, “no harm or harm”, noting that it is allowed for enterprises affected by the Corona crisis to reduce the wage provided that it does not exceed 40% of the actual wage.
She stressed that it is not permissible to reduce wages in the month of Ramadan, during which the actual number of working hours is reduced to 6 hours, and that the reduction is calculated on the number of actual hours, whether in Ramadan or elsewhere.
